No. Backwell contracts civil scope only. We excavate and backfill duct and grounding trenches, build and prepare the pads, and hand off a pad-ready, trench-ready, road-ready site to the electrical contractor or integrator. Keeping the civil and electrical packages separate is also how most storage owners structure the work.

Separation distances between enclosure groups and to lot lines and exposures, and the width, turning radius, turnaround, and surface load rating of fire apparatus access roads, are set by the fire code and by the hazard mitigation analysis the authority having jurisdiction accepts. That makes the access road and pad layout a permit condition rather than a construction preference, and changes to either need to go back through the fire marshal.

Construction stormwater in New York runs under the NYSDEC SPDES General Permit for Stormwater Discharges from Construction Activity, permit number GP-0-25-001, effective January 29, 2025 through January 28, 2030. Coverage is triggered at one acre of soil disturbance, or less if the work is part of a larger common plan, and requires a Notice of Intent plus a SWPPP prepared and implemented under the DEC design manual.

Often, but usually not through the statute people cite. Labor Law Section 224-d applies to a covered renewable energy system as defined in Public Service Law Section 66-p, and that definition lists generating technologies only, so a standalone battery facility falls outside it. Prevailing wage can still attach: Labor Law Section 224-a excludes storage of five megawatts alternating current or less, so larger storage on a qualifying publicly funded project can be covered, and the Public Service Commission order of June 20, 2024 makes prevailing wage a condition on incentivized storage projects of one megawatt alternating current and larger. Confirm the trigger project by project. Backwell is on the NYSDOL public work registry and produces certified payroll where the project requires it.

Both. We contract the civil package directly with the owner or developer, and we run as the civil and earthwork subcontractor under EPCs and integrators. Backwell superintendents, project managers, and lead operators run the site either way, and subcontracted scopes and agency-placed field staff work under Backwell supervision.

Battery enclosures are heavy, closely spaced, and sensitive to differential settlement, so subgrade preparation carries more weight than on a solar array. Proof rolling, undercut and replacement of unsuitable material, engineered fill placed in controlled lifts, and density testing at each lift all sit between clearing and pad construction. Test results gate the pad pour, so testing coordination belongs in the schedule from the start.

Yes. The complete civil package is the core offer, but we price standalone scopes where the owner has already let other portions, including access roads and site entrances, pad subgrade and structural fill, trenching and backfill, stormwater and SWPPP, and perimeter fence. Send the drawings and the scope split and we will price to that split.

Layout Is Fixed by Fire Code

Enclosure spacing, separation to lot lines and exposures, and the access road geometry come out of the fire code and the hazard mitigation analysis, not out of the earthwork plan. We build to the approved layout and flag any field condition that would move a dimension before it moves.

Subgrade Gates the Pads

Proof rolling, undercut, and engineered fill in controlled lifts come before any pad work, and density testing gates the pour. On wet or tile-drained upstate ground the undercut quantity is the single largest schedule risk, so we price it explicitly rather than burying it. See industrial excavation.

Stormwater Starts Before Dirt Moves

Trenching Follows the Electrical Sequence
