The Civil Package We Contract

• Clearing and grubbing: tree and brush removal, stump grubbing, grinding or offsite disposal, topsoil stripping and stockpiling
• Mass grading: cut and fill to design grade, pile-plan grading tolerances, subsoil decompaction on agricultural ground, compaction testing coordination
• Access roads: permanent and temporary aggregate roads, geotextile and geogrid placement, crane paths, culverts and low-water crossings, public road entrances
• Trenching and underground utilities: DC and AC collection trenching, conduit and cable installation support, water and sewer laterals, road crossings and bores coordination
• Erosion control and SWPPP: silt fence, check dams, sediment basins, stabilized construction entrances, inspections and log maintenance, final stabilization with seed and mulch
• Fencing: perimeter security fence, gates, and temporary construction fence
• Substation civil: pad excavation and structural fill, grounding grid trenching, fence, stone surfacing, and access road to the substation yard

We price the package as one scope under one contract. Owners and EPCs get a single point of responsibility for the civil critical path instead of managing separate clearing, earthwork, and utility subcontracts.

Delivery Model

Backwell superintendents, project managers, and lead operators run every site. We mobilize company-owned equipment for core scope and scale each project with leased iron, qualified regional subcontractors, and agency-placed field staff, all under Backwell supervision and a single contract.

• Backwell field leadership on every project: superintendent, project manager, and lead operators are Backwell personnel
• Company-owned core fleet: excavators, dozers, haul trucks, and compaction equipment for the core scope
• Leased equipment at scale: production fleets sized to the earthwork volume and schedule, not to what happens to be in the yard
• Qualified regional subcontractors: prequalified local firms for defined scopes such as fencing, seeding, and hauling, managed by Backwell
• Agency-placed field staff: screened operators and laborers added under Backwell supervision when the schedule demands more hands
• One contract: the EPC or owner holds a single agreement with Backwell for the full civil package

IRA Prevailing Wage and Apprenticeship Readiness

Projects claiming the full Investment Tax Credit or Production Tax Credit under the Inflation Reduction Act must meet prevailing wage and apprenticeship (PWA) requirements. Backwell is set up for that compliance regime:

• Davis-Bacon certified payroll: we run certified payroll on public work in New York today and produce weekly certified payroll records for PWA projects
• Prevailing wage rates: laborer and operator classifications paid at the applicable Davis-Bacon wage determination for the county where the project sits
• Apprenticeship compliance support: labor-hour tracking against the applicable apprenticeship percentage, coordination with registered apprenticeship programs, and documentation of good-faith effort requests where program capacity is unavailable
• Recordkeeping: payroll, classification, and hour records retained and delivered in the format the owner's tax counsel requests

Civil Scope and the Begin-Construction Safe Harbor

Under IRS begin-construction guidance, one way an owner establishes the construction start date for tax credit purposes is by performing physical work of a significant nature on the project site. Civil scope is usually the first work that qualifies. Onsite roads that are integral to the facility, meaning roads used to operate and maintain the project, count as physical work; roads used only for employee or visitor access do not.

That makes the civil contractor part of the tax strategy. Starting access road construction, foundation excavation, or collection trenching in a given tax year can preserve credit eligibility for the project. Backwell documents work performed with dated daily reports, photos, and quantity records so the owner has a clean evidentiary file. Owners should confirm their begin-construction strategy with tax counsel; our job is to put real work in the ground on the date the strategy requires.

Do you take partial scopes?

Yes. The complete civil package is the core offer, but we also price standalone scopes such as access roads, collection trenching, or substation civil where an EPC has already let other portions.

Backwell superintendents and project managers, on site, every day. Subcontractors and agency-placed staff work under Backwell field leadership, and the EPC holds one contract with one responsible party.
