Yes. The USDA Ilion series is a deep, poorly drained till soil influenced by calcareous black shale, found in depressions and toe slopes in the Mohawk Valley and elsewhere.

The lower Steele Creek and its tributaries are on the state priority list for Herkimer County's septic replacement program.

Under 10 NYCRR 75.5 the health department with jurisdiction approves alternative system plans; for Herkimer County that is the NYSDOH Herkimer District Office at 5665 State Route 5.

Homes that pay a sewer bill are on public sewer. Herkimer County runs a county sewer district with a treatment plant and a Frankfort pump station.

Herkimer County Public Health refers environmental health to the NYSDOH Herkimer District Office, 5665 State Route 5, Herkimer. Under 10 NYCRR 75.5, raised bed, mound and sand filter plans need health department approval before construction, and every design must come from a design professional.

Herkimer County participates in the State Septic System Replacement Fund, which reimburses up to 50 percent of eligible costs with a $10,000 cap for properties in DEC and DOH priority areas.

Septic design in Ilion: the short answer

Ilion sits on the south side of the Mohawk in the Town of German Flatts. Houses that pay a sewer bill are on public sewer. Up the hill roads and out in the town, homes run their own systems, and a new house or failed field needs a PE stamped design.

Short answer: the hillsides around Ilion are shale till, sometimes shallow to rock, with poorly drained pockets in the hollows. A soil series called Ilion is one of those wet pocket soils.

Sewer or septic in the Ilion area

Herkimer County operates a county sewer district; its legislature's July 2026 minutes describe plant and Frankfort pump station improvements and emergency repairs at the Mohawk facility. If you pay a sewer bill, you are on public sewer.

Steele Creek, lower and its tributaries, and the upper Moyer Creek are on the state priority list for Herkimer County's septic replacement program, so a failing system near those streams may qualify for a 50 percent grant up to $10,000.

How a septic design works in Ilion

  1. Send the address and a few photos. Use the form below. Estimate in 1 hour, design and install in one written price.
  2. Confirm the lot needs septic. Sewer bill means sewer. Hill road homes without one are on septic.
  3. Deep hole and perc tests. Appendix 75-A requires at least one test hole at least six feet deep at the proposed leaching area and at least two percolation tests per system. Pits on the slopes often show dark shale fragments in the till, with rock at moderate depth in places.
  4. Design and stamp. Designs are prepared and stamped by a New York licensed Professional Engineer (PE), with new homes sized at 110 gallons per day per bedroom or more.
  5. State review for alternative systems. The state's Herkimer District Office is at 5665 State Route 5, Herkimer. Under 10 NYCRR 75.5, raised, mound and sand filter plans need approval from the health department with jurisdiction before construction.
  6. Building permit. The building permit comes from the code enforcement office for the Village of Ilion or the Town of German Flatts, depending on where the lot is.
  7. Install and certify. Backwell coordinates the excavation and builds to the approved plan. An alternative system gets design professional supervision and a written certification to the health department.

Soils and seasonal water around Ilion

The Ilion soil series is described by the USDA as deep or very deep and poorly drained, formed in till strongly influenced by calcareous black shale or limestone and grayish shale, on toe slopes and depressions of upland till plains, with slow or very slow permeability in the lower subsoil and substratum. It occurs in the Mohawk Valley among other places.

Better drained neighbors on the same hills are Mohawk soils, well drained till, and Palatine soils with shale bedrock at 20 to 40 inches. Honeoye soils, well drained, also occur in the Mohawk Valley. The field goes on the Mohawk or Honeoye ground if the lot has it.

What the health department checks

Herkimer County Public Health lists the New York State Department of Health Environmental Unit as its partner for environmental health, and the state's Herkimer District Office serves Fulton, Herkimer and Montgomery Counties. The design rules are Appendix 75-A. For Ilion these are the items that move the design:

  • Conventional trench field: at least 4 feet of useable soil above rock, tight soil and the high seasonal groundwater, with the highest groundwater at least 2 feet below the trench bottom.
  • Shallow trenches: at least 2 feet but under 4 feet of useable soil, 2 feet of separation under every trench, and no more than 30 inches of matching fill over original grade.
  • Raised system: 1 to 2 feet of original soil faster than 60 minutes per inch, high groundwater at least 1 foot below the surface, fill that percs between 5 and 30 minutes per inch, and a taper no steeper than 1 on 3 with at least 20 feet of taper.
  • No absorption system in ground lower than the 10 year flood level, and no field on slopes steeper than 15 percent.

Common Ilion site problems and the design fix

Wet hollow on Ilion soil

Slow permeability and a high water table mean a raised bed or mound, provided high groundwater is at least a foot below the surface.

Shale at 2 to 3 feet

Shallow trenches if there are 2 to 4 feet of useable soil above the rock with 2 feet of separation, otherwise a mound with bedrock at least 2 feet down.

Creek side lot along Steele Creek

Field 100 feet from the creek and above the 10 year flood level. A failing system here may qualify for the state replacement grant.

What it costs

We did not find a published state plan review fee for one house in Herkimer County, so none is quoted. Building permit fees come from your local code office.

Design and install are priced together in writing for the lot. Hillside lots on shale often need fill or a mound.

Grant money: Herkimer County takes part in the State Septic System Replacement Fund, which reimburses property owners up to 50 percent of eligible costs with a $10,000 maximum in priority areas set by DEC and DOH. The state list for Herkimer County includes the lower Steele Creek and its tributaries, the upper Moyer Creek, the middle East Canada Creek, the middle Spruce Creek, the upper West Canada Creek and Hinckley Reservoir, along with many Adirondack lakes in the north of the county.

Timeline

Testing, PE design, NYSDOH Herkimer District Office review for alternative systems, local building permit, install.

Raised beds with finer fill need six months of settling through a freeze and thaw cycle. The written price includes the schedule.
